Boating homicide, soon the crime will be law. The Senate approved in session No. 34 of Jan. 31, 2023, almost unanimously, the abbreviated procedure for the approval of the bill to introduce the crime of boating homicide. That’s what it’s all about.
Boating homicide, equated with road homicide
The new bill “Introduction of the crime of nautical homicide and the crime of nautical bodily injury”(DDL No. 340) presented on the initiative of Senator Alberto Balboni, aims to introduce, in the code penal, the crime of “
nautical murder
“ prevedendo the same discipline preseen for road homicide.
The full text of the DDL will now have to pass through the justice committee, and then go to the chamber for final approval. This is an amendment to the already existing
Article 589-bis on road homicide, to be replaced with:

seven years.
Aggravating factors for driving while intoxicated
The same bill, provides for the punishment aggravating factors related to conducting a of a vessel, an embarkationor a nave, under the influence of alcohollic or altered psycho-fisic conseguente to the intake of narcotics.acents or psicotrope. If these contribute to the causation of the death of a person, imprisonment from eight to 12 years is provided.
Penalty increased in absence of boat license or insurance
Penalty increases are also provided for by the DDL if the offense is committed by a person without a

ocated, and likewise, if the boat is uninsured.
As mentioned above, boating homicide is not yet a state law, the parliamentary process is adjourned until February 9, 2023 at 5 p.m., the deadline for amendments, but it could be passed and out in the official gazette before the start of the 2023 boating season.
