State concessions, berths saved until the end of 2023. But then what?

The berths and buoy places, of many marinas, especially of the smaller ports, now have the certainty of what will happen between now and 2023, concessions confirmed until that date, at which time the new assignments will start, with the new tender rules.

Maritime State Concessions will continue to be effective until December 31, 2023, all those 52,000 berths that were “at risk” as we explained to you here are saved until that date.

They can breathe a sigh of relief to all dock or buoy assignees, and the concession managers and sailing club assignees, who have been left in the lurch of uncertainty since last November, when the Council of State ruling annulled all concessions that had been extended ex officio.

Already expired concessions extended, pending tender arrangements

Yesterday the government approved the bill for the market and competition of state-owned concessions (often called “beach concessions”) that in fact, maintains the effectiveness of currently existing concessions until 12/31/2023. The final expiration date of the concesisons, does not change from that of the sentnce, but it is now defined what happens in the meantime: all concessions, even those already expired and expiring before the date of 31-12-2023, will be kept unchanged until that date. Thus, berths, at the buoy, spaces in boatyards, adjoining storage areas, beach berths, and beach concessions are saved.

Concessions and berths: 6 months for decree

For concessions and berths, an important deadline is also defined with yesterday’s approval. Within 6 months , the government will have to issue new legislation to regulate calls and tenders, which is currently, vacant. The European directives contain the basic principles and guidelines of the criteria by which to define the calls for tenders, we know in essence already in broad strokes, what the decrees to “reorganize and simplify the regulations on maritime, lake and river state concessions” will count.

What we hope for boaters

With the rules coming by September 2022 then, there is more than enough time to get those tenders designed to “ensure rational and more sustainable use of the maritime domain” off to an orderly and well-timed start, from January 01, 2024. From the perspective of the yachtsman, we can hope that a liberalization of concessions will lead to new investments, more competition, more rational management of spaces and concessions, and mooring prices that better respect the real market value.
